Case Trial

March 28th, 2025

Do I have to take my case to trial?

Today, a long-time client called me in a bit of a panic. His case is getting a little older and has not been resolved. His question: do I have to take my case to trial? I recognize he is nervous because he is before a judge in a courtroom; however, sometimes, trial is the only option. My first course of action is to see what we can do to have the charges reduced or dismissed. If dismissal is not an option, we negotiate with the prosecutor, bringing in information like my client’s criminal history, social history, and contributions to the community, all to create the human side of my client. I must show the judge and prosecutor that he is more than his charge. Keep in mind very few of my cases end up in trial; we do everything we can to negotiate upfront or dismiss, but some cases must be tried. And remember that if the case must go to trial, that is when you need a trial attorney.
