If you are operating a vehicle and pulled over and the officer wants you to submit to a breath test, the breathalyzer, it is your right to refuse. As a former prosecutor and now a criminal defense attorney, I believe this is standard advice every criminal defense attorney will provide. However, there are potential consequences. If you refuse to submit, the DMV has the right to suspend your driver’s privileges for up to one year on a first refusal and two years on a second.
While there are some workarounds, and I have protected the driving privilege for many of my clients, there is no guarantee. If you are in this situation, call us immediately. The quicker we get started, the better our chances of protecting you.
