When a client is arrested, the officer will reach for you to put on the handcuffs. Clients will often instinctively pull back or jerk away. As a former prosecutor and now a criminal defense attorney, I’m telling you, don’t do this!
When this happens, you are about to be put down. The officers are trained to take you down when you jerk away and pull back. The first thing you will hear when we listen to the body cam is the officer say “stop resisting.” Generally they will repeat it multiple times and loudly, so everyone around can hear. Not only does this open the door for the officer to add on a resisting arrest charge, but it also clears the officer if you are injured during the arrest. So remember, if you are being arrested, don’t jerk back or pull away, just keep calm, and call Hillman.
