Louisiana negligent homicide

Negligent homicide differs from most murder charges because the intent to kill is not a requirement; it results from an accident. In Louisiana, criminal negligence is defined two ways. The first is killing a human being by criminal negligence. The second is when a dog or other animal kills a human being because of the owner’s negligence in confining or restraining the dog or animal. 

Penalties for negligent homicide

The penalties vary depending on the circumstances. 

* Up to five years of hard labor and up to a $5,000 fine;

* If the victim is under 10, the sentencing range is a minimum of two years of hard labor, without the benefit of probation, parole, or suspension of sentence, and up to five years of hard labor.

Keep in mind the laws and interpretations are continually changing. The above references laws in effect as of 2022 outlined in LSA R.S. 14:32. As rulings come down from different courts and jurisdictions; these rules are apt to change.
