Artificial Intelligence and Images

With the onslaught of artificial intelligence and its impact on an individual’s rights, the legislature is developing laws surrounding A.I. Most recently, effective August 1, 2024, the Louisiana State Legislature enacted R.S. 14:73.14, pertaining to the unlawful dissemination or sale of images of another created by artificial intelligence.  

Under the new law, it is unlawful for any person to coerce, harass, intimidate, or maliciously disseminate or sell any video or image created by artificial intelligence that depicts another person who is nude or in the state of undressed to expose private images. Additionally, it is illegal to disseminate or sell such a video or still image if you know or have reason to know it is not licensed or authorized.

This law is designed to protect someone from creating an image of another individual and disseminating that image in any manner.

Penalties for disseminating AI-generated images

Whoever violates the provision of this law shall be imprisoned for not more than six months, fined not more than $750, or both. Jurisdiction for prosecuting this crime is the Parish where the unlawful act occurred or the video or still image was created, produced, reproduced, found, stored, received, or possessed. 

Keep in mind the laws and interpretations are continually changing. As rulings come down from different courts and jurisdictions, these rules are apt to change.
