Child Pornography, what you need to know in Louisiana

In the state of Louisiana, there are strict laws penalizing the possession of child pornography. If charged with child pornography, this is not something you should take lightly. The reality is, many people, upon initially being arrested, are presumed guilty. How does the Louisiana law define possession of child pornography:
Louisiana revised statute 14:81.1 defines pornography involving juveniles, in part, as literally a photograph, videotape, film, or other reproductions, whether electronic or otherwise, of any sexual performance involving a child under the age of 17. Keep in mind this is a vast net. It could mean, quite literally, the exhibition of private body parts. In addition, the penalties for possession of pornography involving a juvenile are steep, ranging from a minimum of five years at hard labor and up to 20 years, without the benefit of probation, parole, or suspension of sentence, and up to a $50,000 fine. The statute penalizing possession of pornography involving a juvenile is long and detailed; however, this portion of the law covers most of the cases I receive in my office.

Does sexual intent matter?
Absolutely not. Any image portrayed as being lewd is enough to constitute a charge of pornography involving a juvenile. While the district attorney and the court system will consider the nature of the image or photograph, leniency is rarely given on this type of charge.

How do I overcome the legal ramifications of this charge?
While you are aware that possession of pornography involving a juvenile carries serious consequences, the best way to protect yourself is to be found not guilty.
